2. Purpose and Scope
These Terms establish the rules that apply when you use the Website and our Products or Free Resources.
GB Visual Studio provides educational and creative resources primarily for entrepreneurs, freelancers, creators, businesses, marketers, and designers. Unless expressly stated otherwise, Products and Free Resources are supplied digitally and are not physical goods.
These Terms apply to your use of the Website, your purchase, download, or use of Products, your use of Free Resources, your subscription to email communications, your access to Website Content, and any other use of our digital resources or services.
Certain Products may include additional licensing or usage terms. Where product-specific terms apply, those terms form part of your License for that Product.
3. Acceptance of These Terms
By using the Website or purchasing or downloading a Product, you confirm that:
you have the legal capacity to enter into an agreement under applicable law;
you will use the Website and Products only for lawful purposes;
the information you provide to us or our payment providers is accurate;
you will respect the intellectual property rights of GB Visual Studio and third parties; and
you will comply with these Terms and applicable laws.
If you are using the Website or purchasing a Product on behalf of a business or other organization, you represent that you have authority to accept these Terms on its behalf.
4. Eligibility and Acceptable Use
You may use the Website for personal, educational, professional, or business purposes, subject to these Terms.
You agree not to:
use the Website or Products for unlawful, fraudulent, deceptive, or harmful purposes;
infringe or attempt to infringe the intellectual property or other rights of GB Visual Studio or another person;
copy, reproduce, republish, distribute, or commercially exploit our Content except as expressly allowed under these Terms;
share, sell, sublicense, transfer, or redistribute purchased or free downloadable files;
upload our original files to marketplaces, file-sharing services, repositories, or other public download locations;
attempt to gain unauthorized access to our Website, systems, accounts, or files;
interfere with the operation, security, or availability of the Website;
introduce malicious code, viruses, malware, or other harmful material;
use automated systems, scraping tools, bots, or similar methods to systematically collect our Content without permission;
impersonate another person or misrepresent your relationship with GB Visual Studio; or
use our Products or Content in a way that violates applicable law or third-party rights.
We may restrict, suspend, or terminate your access where we reasonably believe that you have violated these Terms or misused the Website or our Products.
5. Intellectual Property
Unless otherwise stated, all Website Content and Products are owned by or licensed to GB Visual Studio and are protected by applicable intellectual property laws.
Our intellectual property includes, without limitation:
the GB Visual Studio name and brand identity;
logos, marks, and visual assets;
templates and design systems;
workbooks, worksheets, checklists, and guides;
ebooks and educational materials;
graphics, icons, illustrations, photographs, and videos;
blog articles and written content;
product descriptions and sales materials;
downloadable files and source files;
website design, layout, and user interface elements; and
other original creative materials made available through the Website.
Except for the limited rights expressly granted to you under these Terms, no ownership or other intellectual property rights are transferred to you by accessing, purchasing, downloading, or using our Products.
6. Product License
When you purchase a Product, you receive a limited, non-exclusive, non-transferable, revocable license to use that Product in accordance with these Terms and any applicable product-specific license.
Your purchase gives you permission to use the Product. It does not transfer ownership of the Product, the original design files, or the underlying intellectual property.
Unless a Product states otherwise:
the license is intended for the purchaser;
you may not share your download files or download links with other people;
you may not transfer your license to another person or business; and
your license ends if it is terminated under these Terms.
7. Commercial Use
Unless a Product’s individual license states otherwise, our templates and other applicable Products may be used to create finished work for personal or commercial purposes.
You may generally:
use a Product for your own business;
customize and edit the Product;
use the Product to create work for clients;
incorporate the Product into a completed design, presentation, marketing asset, or other finished deliverable; and
use the resulting finished work commercially.
You may not:
resell the original Product or template file;
distribute the original file or an editable copy to clients or other third parties unless expressly permitted;
offer the original Product as a free download;
upload the Product to a marketplace, template library, file-sharing site, or repository;
claim the original Product or its underlying design as your own;
remove ownership or copyright notices where they are included; or
create a competing template, resource, or product substantially based on the original Product for resale or redistribution.
Commercial use applies to eligible finished work you create with the Product, not to the underlying Product itself.
8. Free Resources
We may make selected resources available free of charge.
Free Resources remain our intellectual property unless expressly stated otherwise. A free resource may be used according to the license stated on its download page or, where no separate license is provided, under the same general restrictions that apply to our Products.
You may not sell, redistribute, upload, share, or repackage the original Free Resource as your own product without our prior written permission.
9. Orders and Payments
Products may be sold directly through the Website or through third-party payment and delivery providers, including Gumroad.
When you make a purchase:
you agree to provide accurate and complete payment information;
you authorize the applicable payment provider to process the transaction;
you agree to the payment provider’s own terms, policies, and procedures; and
you acknowledge that payment processing and digital delivery may depend on third-party systems.
Prices may be changed at any time. A price change will not affect a purchase that has already been successfully completed.
We may refuse or cancel a transaction where there is a reasonable basis to suspect fraud, unauthorized activity, abuse, or a violation of these Terms.
10. Digital Delivery
Our Products are digital and are normally delivered electronically after successful payment.
Where purchases are processed through Gumroad or another third-party platform, delivery may occur through that platform. Delivery can occasionally be delayed by payment verification, technical issues, platform maintenance, or other circumstances outside our reasonable control.
You are responsible for using a valid email address when purchasing, maintaining access to your purchase account or delivery email, downloading your Product when it becomes available, and keeping your purchased files in a safe place.
If you have a genuine technical problem accessing a purchased Product, contact hello@gbvisualstudio.com and we will make reasonable efforts to assist.
11. Refunds, Exchanges, and Cancellations
Because Products are digital and may be delivered immediately, all sales are final unless otherwise required by applicable law or expressly stated on the relevant product page.
Except where applicable law requires otherwise, we do not provide refunds, exchanges, or cancellations for:
change of mind;
accidental purchase;
failure to read the product description;
incompatibility with a user’s preferred software, workflow, or device where compatibility information was disclosed;
failure to use or download a Product after purchase; or
dissatisfaction with the creative or educational outcome of a Product.
Where a technical problem prevents reasonable access to a purchased Product, we may, at our discretion, provide access to the Product or another reasonable solution.
Nothing in this section excludes consumer rights that cannot legally be excluded under applicable law.
12. Use of Canva and Other Software
Some Products may be designed for use with third-party software or platforms such as Canva, Adobe applications, presentation tools, or other creative software.
You are responsible for maintaining any account, subscription, software, device, or internet connection required to use such Products.
We do not control third-party platforms and cannot guarantee their continued availability, features, pricing, compatibility, or policies.
Where a Product depends on a third-party platform, that platform’s own terms and policies may also apply.
13. AI and Generative Tools
Unless a Product-specific license states otherwise, you may use our Products as part of your normal creative workflow alongside AI-powered or generative tools.
However, you may not:
upload our original Products to datasets used to train artificial intelligence models;
use our original Products to train, fine-tune, benchmark, or improve an AI model;
distribute AI-generated or AI-assisted versions of our original templates as substitutes for the original Product;
use our Products to create a competing library of templates or resources for distribution or sale; or
represent the original GB Visual Studio Product, its original design, or its underlying intellectual property as your own.
You remain responsible for ensuring that your use of AI tools complies with the terms of those tools and applicable law.
14. User-Submitted Information
You may provide information to us when contacting us, subscribing to our newsletter, submitting inquiries, or otherwise communicating with GB Visual Studio.
You remain responsible for ensuring that any information you provide is accurate and that you have the right to provide it.
We may use information you voluntarily provide as reasonably necessary to respond to inquiries, provide requested services, deliver communications, administer purchases, and operate the Website, subject to our Privacy Policy.
You should not send confidential information to us unless it is necessary for your request and appropriate for the communication channel.

By subscribing, you agree to receive communications such as educational content, product announcements, updates, promotions, new resource announcements, and other communications related to GB Visual Studio.
You may unsubscribe at any time using the unsubscribe mechanism included in our emails or by contacting us.
Our handling of personal information is governed by our Privacy Policy.
16. Affiliate Links and Recommendations
Some pages may contain affiliate links to third-party products, services, software, or platforms.
Where you make a purchase through an affiliate link, GB Visual Studio may receive a commission at no additional cost to you.
Affiliate relationships do not guarantee that a third-party product will meet your needs. We do not control third-party products or services, and your use of them is subject to the provider’s own terms, policies, pricing, availability, and practices.
17. Third-Party Websites and Services
The Website may contain links to third-party websites, services, software, platforms, or resources.
These third parties are independent from GB Visual Studio. We do not control and are not responsible for their content, privacy or security practices, products or services, availability or functionality, pricing or policies, or losses resulting from your use of third-party services.
Your use of a third-party website or service is at your own risk, and you should review its applicable terms and privacy policy.
18. Website Availability and Changes
We aim to keep the Website and our resources available and functional, but we do not guarantee uninterrupted or error-free access.
The Website or any Product, Free Resource, feature, page, link, or service may be changed, updated, suspended, or discontinued at any time.
We may also correct errors, update Product files, revise descriptions, or make improvements without prior notice where reasonably appropriate.
We are not responsible for temporary unavailability caused by maintenance, technical problems, internet outages, third-party failures, security incidents, or circumstances beyond our reasonable control.
19. Educational Disclaimer
Our Website, Products, blog articles, guides, templates, and other resources are provided for general educational and informational purposes.
They are not legal, financial, tax, accounting, investment, medical, or other professional advice.
You are responsible for determining whether a resource is appropriate for your particular situation. Where professional advice is necessary, you should consult a suitably qualified professional.
20. No Guarantee of Results
GB Visual Studio does not guarantee any particular business, branding, financial, marketing, audience, sales, productivity, or creative result from using our Products or resources.
Results depend on many factors, including your skills, implementation, effort, business model, market conditions, audience, competition, and other circumstances outside our control.
Any examples, testimonials, case studies, or results presented on the Website are illustrative and should not be treated as a promise or guarantee of future results.
21. Intellectual Property Complaints
We respect the intellectual property rights of others.
If you believe that material published by GB Visual Studio infringes your copyright or other intellectual property rights, please contact us at hello@gbvisualstudio.com with sufficient information for us to understand and investigate the claim.
Similarly, unauthorized copying, sharing, redistribution, resale, or other misuse of our Products may result in suspension or termination of the relevant license and may lead to other remedies available under applicable law.
22. Suspension and Termination
We may suspend or terminate your access to the Website, Free Resources, or Products, or terminate a Product License, where we reasonably believe that you violated these Terms, infringed our intellectual property rights, shared or redistributed our Products without permission, used the Website for unlawful or harmful activities, or engaged in conduct that materially harms GB Visual Studio or its users.
Where appropriate, we may take action without prior notice.
Termination does not remove rights or obligations that arose before termination. Provisions relating to intellectual property, licensing restrictions, disclaimers, limitation of liability, indemnification, governing law, and other provisions intended to continue by their nature will remain effective.
23. Limitation of Liability
To the fullest extent permitted by applicable law, GB Visual Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
your use of or inability to use the Website;
your use of our Products or Free Resources;
loss of profits, revenue, business opportunities, or goodwill;
loss of data;
business interruption;
errors or omissions in Website Content;
technical interruptions or failures; or
products, services, actions, or failures of third parties.
To the fullest extent permitted by applicable law, if GB Visual Studio is found liable for a claim relating to a purchased Product, our aggregate liability will not exceed the amount you actually paid for the specific Product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
24. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless GB Visual Studio, its owner, affiliates, licensors, and service providers from claims, losses, liabilities, costs, and reasonable expenses arising from:
your violation of these Terms;
your misuse of the Website or Products;
your infringement of third-party rights;
your unlawful conduct; or
your use of our Products in a manner not permitted by the applicable License.
25. Privacy
Your use of the Website is also subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information.
By using the Website, you acknowledge that you should review our Privacy Policy together with these Terms.
26. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of India, without regard to conflict-of-law principles to the extent permitted by applicable law.
Any dispute arising out of or relating to these Terms, the Website, or our Products shall be subject to the jurisdiction of the competent courts in India, subject to any mandatory rights or remedies available to you under applicable law.
27. Force Majeure
GB Visual Studio will not be responsible for delay, interruption, or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, cyber incidents, internet or telecommunications failures, power outages, labor disputes, platform outages, or failures of third-party providers.
28. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
29. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
A waiver of any particular provision will be effective only to the extent expressly provided.
30. Entire Agreement
These Terms, together with our Privacy Policy and any product-specific license or legal policy referenced by the Website, constitute the agreement governing your use of the Website and our Products.
They supersede prior understandings relating to the same subject matter, except where a separate written agreement expressly applies.
